Applicant has preferred this application under Section 438 of CrPC, for grant of anticipatory bail to the applicant, apprehending his arrest in connection with unregistered Crime by Police Station- Mahila Thana, Bilaspur Chhattisgarh for the offence punishable under Section 376 of IPC. 2.

Shri BD Guru, learned counsel for the applicant submits that on the last date of hearing, a direction was issued to learned State counsel to verify status of complaint filed against the applicant.

Shri BL Sahu, learned State counsel submits that as per information received by the Office on 03.07.2021, no offence is registered against present applicant.

Learned counsel for the applicant submits that in such a situation, he may be permitted to withdraw this bail application with liberty to approach appropriate Forum by filing fresh application, if occasion arises. 5.

As prayed, MCRCA-241 of 2021 is dismissed as withdrawn, with aforementioned liberty.
