1. Heard.

2. The grievance of the petitioner is that in a revenue case, appeal was preferred by the petitioner against the order of the Naib Tehsildar the respondent No.3, it would be evident from the Annexure P-6. It is stated that to decide the appeal, the lower Court record would be necessary, however, despite the repeated efforts and the requisition though have been made by the SDO, Nawagarh, the records are not being sent, which is evident from the order-sheet. Therefore,

the respondent No.3 may be directed to send the record as per the order of the SDO, Nawagarh, forthwith and respondent No.2 SDO before whom the appeal is pending may be directed to decide the same as expeditously as possible.

Perusal of Annexure P-6 would show that the appeal has been preferred by the petitioner and several order-sheets have been shown that the records have been called for from the Court of the Naib Tehsildar. Under the circumstances, the respondent No.3 is directed to send the record to the SDO within a period of 30 days from the date of receipt of this order and the SDO thereafter shall decide the appeal as expeditiously as possible according to the pendency.
