1. This is the Second Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 02.02.2016 in connection with Crime No. 145/2015 registered at Police Station Pandri, Raipur, Distt. Raipur (CG) for the offence punishable under Sections 420, 467, 468, 471, 120 (B) of the I.P.C.
2. Heard on I.A. No.01/2018, application for grant of temporary bail.
3. Learned counsel for the applicant would submit that the temporary bail has been preferred on the ground that the father of the applicant has died on 08.01.2018 and he has to perform the last rituals. Therefore, he may be released on temporary bail for a period of 15 days
4. Learned State counsel opposes the prayer for grant of temporary bail, however, he do not dispute the fact about the death of the father of the
applicant.
5. Along with the bail application, death certificate issued by the Shri Krishna Hospital, Main Road, New Rajendra Nagar, Raipur is also enclosed. In view of this, I am inclined to release the applicant on temporary bail for a period of 15 days from the date of release.
6. Accordingly, I.A. No.01/2018, application for grant of temporary bail is allowed.
7. It is directed that the applicant shall be released on temporary bail for a period of 15 days from the date of his release on furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. It is directed that the applicant shall surrender immediately after completion of 15 days before the trial Court.
8. With such direction the bail application also stands disposed of.
