The grievance of the Petitioner through the present Writ Petition is nonconsideration of their name for promotion from the post of constable to the post of head constable.

The State Government in their return have submitted that pending the Writ Petition the Petitioners have been granted promotion as reflected from Annexure R/1 dated 13.07.2007. As such the grievance raised by the Petitioners stands redressed and Petition has become infructuous.

Mr. Bhatia, Counsel submits that though Petitioners have been promoted, it appears that the Respondent have granted promotion subsequently but they ought to have promoted them from the back date. Mr. Bhatia further submits that the Petition may be disposed off at this juncture with a liberty to the Petitioners if at all they are still aggrieved of they being not promoted from the back date they may make suitable representation to the higher authorities in the Department for redressal of their grievance. 4.
Learned State Counsel does not oppose the same. 5.
Accordingly, at this juncture taking into consideration the subsequent promotion granted to the Petitioners the Petition is disposed off with the aforesaid liberty to the Petitioners that if in case they are still aggrieved of not being promoted from the back date they may make suitable representation to the Respondent in this regard who inturn should look into the matter and take appropriate decision.
