1. By the impugned order, the trial court has rejected the plaintiffs' application filed under Order 1 Rule 10(2) of the C.P.C.
2. I have heard learned counsel for the parties and perused the impugned order.
3. Defendants have sold the property during the pendency of the suit on 10.09.2014 and that will be governed by Section 52 of the Transfer of Property Act. Even otherwise, plaintiff's application under Order 6 Rule 17 of the C.P.C has been allowed. It is made clear that the alienation made by the defendants in favour of the purchaser will be governed by Section 52 of the Transfer of Property Act.
4. With the aforesaid observation, this writ petition finally stands disposed of. No order as to cost(s).
