None appeared on behalf of the Petitioner even when the case was called out for second occasion.

This Petition is of the year 2010 whereby the Petitioner sought for quashment of the departmental inquiry and illegal order of suspension passed by Respondent No. 4.

Learned State Counsel submits that during the pendency of the Petition the suspension order has already been revoked by the Respondent . The Petitioner has resumed to his duty and only the departmental inquiry was in progress in year 2010 and as such his grievance so far as the suspension
part is concerned stands redressed.

Taking into consideration total facts and circumstances of the case in the opinion of this Court by the current year 2016 with the efflux of time the departmental inquiry initiated against the Petitioner must have been completed. Even if the departmental inquiry has not been completed as of now it will not be advisable for interfering with departmental inquiry at this stage. If the departmental inquiry has not been completed till date the Respondent is directed to complete the inquiry as early as possible and act in accordance with law.
