1. By order dated 03.10.2016 passed in WPC No.2406/2016, this Court has directed to remit the matter back to the Collector, Balodabazar- Bhathapara to examine the complaint/irregularity committed by the petitioner by a Committee under Clause-11 of the agreement and based on the recommendation of the Committee, the Collector shall

CONT No. 554 of 2016 pass the order in accordance with law.

2. Applicant's counsel would submit that after the order was passed in writ petition, applicant was allowed to supply ready to eat food material for three days but thereafter it was again withdrawn.

3. Mr. Vivek Sharma, learned counsel for the respondents submits that pursuant to the order passed by this Court, the concerned Collector constituted a Committee vide Annexure R1 and thereafter, based upon recommendation of the Committee, the work of supply of ready to eat food material was given to some other agency.

4. In view of the above, the order passed by this Court appears to be duly complied with. Applicant has not submitted any material before this Court countering the document Annexure R1. If the applicant is aggrieved by the subsequent order passed by the Collector handing over the work of supply of ready to eat food material to some other agency, the remedy is to file fresh petition.

5. In view of the above observation, the contempt petition deserves to be and is hereby disposed of.
