Sam Koshy Order On Board By 04/12/2015 The claim of the petitioner is that he should be granted the benefit of Career Advancement Scheme as floated by the University Grant Commission vide order dated 19.10.2006 Annexure P-4.

According to the petitioner, he retired on 31.03.1998 and the scheme was made applicable for those persons who had completed five years' service on 01.01.1996. 3.

A perusal of Annexure P-4 would reflect that the U.G.C while issuing the said order has stated that the Career Advancement Scheme will be effective from 27.07.1998 onwards which itself makes it clear that those persons who were not in employment on 27.07.1998 would not be entitled for the benefit of the said Scheme. Admittedly the petitioner had retired on 31.03.1998 and therefore, in the opinion of this Court, the petitioner would not fall within the ambit of those persons who would be entitled for the

benefit of Career Advancement Scheme on account of his being not in employment on 27.07.1998.

Accordingly, the instant writ petition being devoid of merits is dismissed.
