NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Civil Revision No.94 of 2017 Omkar Sahu S/o Shri Janakram Sahu, aged about 24 years, R/o Sankari Thana Mandir Hasaud Dist Bilaspur (CG) ----Applicant

Versus

Smt. Asin Bai Baghel W/o Shri Chait Ram Khilare, aged about 28 years, R/o Village Salauni, Thana Abhanpur, Distt. Raipur (CG) ---- Respondent For Applicant :

Mr.Akhilesh Kumar, Advocate Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 28/9/2018

1. The present civil revision has been filed against the order dated 28.3.2017 passed by the Principal Judge, Family Court, Raipur in Civil Case No.603/2016, whereby the Family Court has granted ₹ 800/- per month as an interim maintenance to the respondent.

2. Learned counsel for the applicant would submit that the order passed by the Family Court is unsustainable and bad in law.

3. I have heard learned counsel for the applicant, perused the impugned order and other documents appended with civil revision.

4. Undisputedly, proceeding for dissolution of marriage is pending before the Family Court, Raipur, in which application for interim maintenance has been considered and granted an amount of ₹ 800/- per month as an interim maintenance to

the respondent. Even otherwise, the amount so granted cannot be said to be excessive rather in lower side. I do not find any illegality in the impugned order.

5. Accordingly, the civil revision being devoid of merit is liable to be and is hereby dismissed. No cost(s).
