AWARD fPassed on 12-09-2015) (1) The parties have filed compromise petition.
(2) By way of compromise, both the parties, the petitioner and respondent No.l - Jagdish Lata, have agreed that respondent No.l shall be given reinstatement in service without back-wages which is acceptable to the respondent.
(3) Both the parties to the dispute have also agreed upon that they shall not challenge the order of reinstatement of the respondent and the respondent, in turn, shall also not challenge the non-granting of back-wages, before any forum or Court of Law.
(4) In view of compromise entered into between the parties, the writ petition stands disposed- of and the order dated 27.09.2007 passed by the Industrial
Court, Raipur, and the order dated 13.02.2007 are hereby affirmed. The Respondent No.l shall be reinstated in service without back-wages. (5) It is also brought to the notice of the Fomm that the respondent is already in employment by vtrtue of order passed by the Industrial Court. Therefore, the period of service shall also be taken into consideration for computing the length of service of the petitioner.
