At the outset, learned counsel for the petitioner would fairly submit that the petition was filed seeking direction for grant of higher pay scale at par with the pay scale granted to compounder in the Health Department on the ground of parity but now the petitioner has received an order dated 11.01.2018 passed by the Government by which the claimed pay scale has been granted to Compounder of the Technical Education Department though notionally from 01.04.2006, restricting the actual monetary benefit only with effect from 1st January, 2016. Therefore, in these changed circumstances, the petitioner may be permitted to withdraw the petition with liberty to file representation in so far as denial of actual monetary benefit from 01.04.2006 is concerned.

In view of development having taken place in view of order dated 11.01.2018,

the petitioner is permitted to withdraw the petition with liberty to claim actual monetary benefit with effect from 01.04.2006. The same shall be considered and decided by the authority also on its own merit. 3.

Needless to emphasize, in case, the grievance is not redressed, it will be open for the petitioner to take recourse to remedy as may be available to him under the law.
