Hon'ble Shri Justice Goutam Bhaduri Order on Board 24.01.2020

1. The challenge in the present writ petition is to the order dated 10.09.2014, whereby the punishment has been imposed for stoppage of one annual increment with cumulative effect against the petitioner. As the impugned order has imposed the stoppage of one annual increment with cumulative effect therefore the petitioner would have a continuous cause of action.

2. The contention of the petitioner as has been stated that this order was passed without giving him any opportunity of hearing, If it is so, those facts can be adjudicated before the Appellate Authority under Chhattisgarh Panchayat (Appeal & Revision) Rules, 1995 before the

-2Commissioner. Therefore, I am not inclined to allow this writ petition as the alternative efficacious Appellate authority is available to the petitioner.
