The petitioner was a student of Diploma in Mechanical Engineering in the MM College of Technology, Raipur, however, he had not cleared all the papers of the said examination as he had one backlog paper. For lateral admission directly to the 3rd semester Bachelor Engineering course from amongst the Diploma holders, the counseling programme was issued on 9-11-2020, which was scheduled to be held on 19-11-2020 and the admission was to be concluded by 22-11-2020. The said counseling programme was extended till 31-12-2020, however, by that time, the supplementary examination for the backlog paper was not over and, thus, the petitioner was not eligible for participating in the counseling.

In this writ petition, the petitioner is seeking a relief for a direction to the respondents to extend the last date of admission into third semester B.E. course through lateral entry.

Having heard learned counsel for the petitioner, we are afraid, no such relief, as claimed in the writ petition, can be allowed for the simple reason that as on last date of admission process, the petitioner was not eligible for participation in the admission process because he was yet to clear his diploma examination. Thus, no case is made out by the petitioner for interference. 4.
