The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.08/2018, registered at Police Station Raghunathnagar, District Balrampur-Ramanujganj, for the offence punishable under Sections 366, 376, 394 (dha) & 34 of IPC.

The prosecutrix, aged about 28 years, has alleged commission of rape by the present applicant as well as by the co-accused Sadhunath and the third accused, who is a juvenile. 3.

The co-accused Sadhunath, S/o Bhola Singh has already been released on regular bail in MCRC No.2873/2019.

Learned State counsel would oppose the prayer for grant of bail. 5.

Having considered the prosecution allegation and for the fact that the co-accused Sadhunath has already been released on bail by this Court, the prayer for grant of regular bail is allowed. The applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
