Petitioner Bhuwan Dhankar was working as peon in Main Ayurvedic Hospital, Rajnandgaon and petitioner Babudas was working as Peon in Municipal Corporation, Rajnandgaon. Both the petitioners have crossed the age of 60 years in the year 2008-09.

Admittedly, the rules do not disclose the age of superannuation to be 62 years and both the petitioners have superannuated on attaining the

age of 60 years and as such the petitions by efflux of time have become infructuous.

Accordingly, both the writ petitions stand dismissed as having become infructuous.
