1. Learned counsel for the petitioner submits that petition under Section 9 of the Hindu Marriage Act, 1955 filed by the respondent before the Family Court, Rajnandgaon is decided by the said Court finally, therefore, the present petition has become infructuous.

2. In view of the aforesaid submission made by learned counsel for the petitioner, present petition is dismissed as having become infructuous.
