Versus

State Of Chhattisgarh Through Station House Officer, Police City Kotwali, Baloda Bazar, District Baloda Bazar Bhatapara Chhattisgarh, District : Balodabazar-Bhathapara, Chhattisgarh ---- Respondent For Applicant :

Ms. Anusueya Rajput, Advocate For State :

Shri Majid Ali, Dy. Govt. Advocate S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 02/02/2018 Heard.

1. The applicant has been arrested in connection with Crime No.334 of 2016 registered in Police Station- City Kowali, Baloda Bazar, District- Baloda Bazar (C.G.) for alleged commission of offence under Section 376 (2) (g) and 506 IPC, Sections 4 & 6 of the Protection of Children from Sexual Offences Act and Section 67 (A) of the Information Technology Act.

2. This is the third bail application on behalf of the applicant. Learned counsel for the applicant would argue that this application has been moved after examination of the prosecution (PW.4) whose statement before the Court is very shaky and does not clearly involve the applicant in the alleged commission of offence and the story that the applicant committed rape on the

-2prosecutrix is highly improbable.

3. On the other hand, learned counsel for the State has opposed the bail application.

4. Having considered the submissions made by learned counsel for the parties, looking to the nature and gravity of offence alleged, I am not inclined to grant bail to the applicant.

5. The application is therefore rejected.
