It is pointed out by Shri Ghanshyam Patel, learned counsel for the respondents that this is second round of litigation; earlier petition filed by the petitioner seeking the same relief, has already been dismissed in default on 09.04.2010. Instead of filing any application for revival of the said petition by making the defaults good, the instant petition has been filed. 2.
Since the earlier petition seeking the same relief has already dismissed and the same has not been revived by filing appropriate application, therefore, the subsequent petition seeking the same relief, is not maintainable. 3.
