Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 2 8 /0 2 /201 (1) In the affidavit filed the Director, Public Instruction Department, in compliance of this Court's order dated 29.01.2018, statement has been made in paragraph 4, which states as under:-

"4. It is respectfully submitted that the Joint Director, Treasury, Audit and Pension Raipur (CG) has objected for payment of pension and gratuity, for the recovery of excess payment from the petitioner gratuity has been not paid to him, it is respectfully submitted that if the petitioner is ready to accept the gratuity amount of Rs.247098.00, the answering respondent is ready to release the same as soon as possible."

(2) In view of above, learned counsel appearing for the petitioner would submit that the petitioner is ready and will to accept the amount of gratuity as mentioned in paragraph 4 of the affidavit filed by the Director, Public Instructions Department subject to final outcome of the Writ Petition (S) No. 3559 /2017.
