1. Learned counsel representing the respondent bank has handed over to the Court a Xerox copy of the application filed by the appellant before the Authorized Officer making commitment of repayment on the dates mentioned therein. First instalment of Rs.40 lakhs has already been deposited which the learned counsel for the respondent bank accepts.
2. In view of the same, the respondent bank has already issued a public notice dated 7.2.2019 withdrawing the auction notice issued earlier with regard to the mortgaged properties.
3. Accordingly, the writ appeal stands disposed off. It is for the appellant now to decide whether he would like to redeem his properties by settling the account within the time frame indicated in the said application or a negotiated settlement between him and the bank.
