1. The matter is listed in default(s) for non-compliance of order passed by this court on 26.06.2019.

2. This Misc. Appeal has been preferred under Section 30 of the Employee's Compensation Act, 1923 (herein after referred to as the 'Act 1923') questioning the award impugned dated 07.12.2018 passed by Commissioner, Employee's Compensation-Cum Labour Court Rajnandgaon in Case No. 03/W.C. Act/2011/Fatal, without complying the mandatory provisions as provided under third proviso to sub-section (I) of Section 30 of the Act. The said compliance has not been made

despite sufficient opportunity being given by this Court as evidenced by order sheets dated 06.02.2019 and 26.06.2019.

3. In view of the aforesaid facts and in view of the non-compliance of the mandatory provisions as prescribed under Section 30 of the Act, 1923, the appeal preferred by the employer is not entertainable.
