1. The applicant has preferred this application for grant of anticipatory bail, as she apprehends her arrest in connection with Crime No.333/2019, registered at Police Station Baradwar, District Janjgir-Champa, for offence punishable under Section 498-A read with Section 34 of the Indian Penal Code.
2. Complainant was married to applicant's son on 19-4-2018. She is residing separate from her husband since May, 2018, but lodged the FIR on 15/12/2019. The husband of the complainant moved the petition for grant of divorce in January, 2019.
3. Learned State Counsel would oppose the prayer for grant of bail.
4. Considering the fact that the applicant, who is the mother-inlaw of the complainant, aged about 45 years, and her son has filed prior petition for grant of divorce and thereafter the present complaint has been filed, this Court is inclined to release the applicant on anticipatory bail.
5. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, she shall be released on anticipatory bail on her executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (a) she shall make himself available for interrogation by a police officer as and when required;
(b) she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
