DB : Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Rajani Dubey Order On Board by Hon'ble Shri Justice Manindra Mohan Shrivastava 25/04/2019
1. Heard on application for condonation of delay in filing appeal.
2. Appeal is barred by 214 days.
3. After going through the application for condonation of delay, we find that the cause shown for delay is extremely vague and unspecific and all that has been stated is that the appellant had no knowledge of the period of limitation in filing appeal, which does not constitute a valid ground. Otherwise also, we find that by the impugned order only interim maintenance is granted to the wife. In the background that in 125 Cr.P.C. proceedings, Rs.
1200 has been granted to the wife, the Family Court has awarded Rs. 2,000/- as litigation expenses and Rs. 1,000/- as maintenance. Therefore, we are not inclined to condone the delay.
4. Accordingly, this appeal is dismissed as barred by limitation. Sd/- Sd/- (Manindra Mohan Shrivastava) (Rajani Dubey) Judge Judge vijay sahu
