Advocate, for the State. 15.03.2019 The present MCC has been filed seeking for extension of time to remove the default and restoration of WPS No. 4974/2018 which got dismissed on account of peremptory order passed by this Court on 12.09.2018.
Facts of the case are that WPS No.4974/18 was filed before this Court where there were certain defaults and this Court had passed a peremptory order on 12.09.2018. Since the defaults were not cured, the writ petition got dismissed by virtue of the peremptory order. Subsequently, MCC No. 966 of 2018 was filed for restoration of the writ petition. This Court allowed the said MCC vide order dated 03.01.2019 without imposing any cost subject to the petitioner curing the default within a period of 7 days. It appears that the petitioner has not cured the default within the stipulated period and therefore, the order passed in MCC No.966/18 lost its efficacy which led to the filing of the present MCC. On due consideration, the present MCC is allowed. It is directed that subject to the applicant depositing cost of Rs.750/- towards the
Chhattisgarh High Court Bar Association Library Fund Account No. 32749718036 and furnishing receipt of the same within a period of 7 days from today to the Registry of this Court, WPS No. 4974 of 2018 shall be restored to its original number. It is further directed that the default pointed out by the Registry in WPS No. 4974/18 shall be cured within a further period of 7 days from the date of restoration of the Writ petition. Sd/- (P.
