1. Mr. Neeraj Pradhan, learned counsel appearing for the petitioner, would submit that the petitioner's DA, pension and gratuity have wrongly been calculated as for 22 years 5 months & 13 days instead of for 34 years 5 months & 7 days for correction of which he has filed an application / representation before respondent No.1 and has also expressed his willingness to deposit ₹ 26,193/-, but the said application / representation has not been considered and decided.

2. Mr. Animesh Tiwari, learned State counsel, would submit that if representation afresh is filed by the petitioner within two weeks from today that will be considered and decided within a period of 60 days

from the date of receipt of the same.

3. Accordingly, the petitioner is permitted to make a fresh representation raising his grievances making the claim for DA, pension, gratuity, etc., within two weeks from today and the respondent authorities shall consider and decide the same by a reasoned and speaking order in accordance with law within a period of 60 days from the date of receipt of the representation. The petitioner shall also submit his willingness in writing to the respondent authorities that he is ready and willing to deposit the amount of ₹ 26,193/-. However, taking into consideration that the matter is pertaining to DA, pension and retiral benefits of the petitioner who is a retired employee, the respondents shall consider and decide the same as expeditiously as possible, in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the matter.

4. The writ petition is allowed to the extent indicated herein-above. No order as to cost(s).
