This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicant has been arrested in connection with Crime No.13/2019 registered at Police Station- Sarangarh, Civil & Revenue District Raigarh (C.G.) for the offence punishable under Sections 34 (2) & 59(A) of CG Excise Act.

Case of the prosecution, in brief is that on 05/01/2019, 25 bulk liters hand made country liquor has been seized from the possession of the applicant. 5.
Counsel for the State submits that two other criminal cases under Excise Act have already been registered against the applicant in police case diary. 6.
Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- along with a personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned, he be released on bail. 7.
