The Trial Court has acquitted the accused of the charges under Section 302 of IPC.

The deceased Amir Baksh and the accused Ramjan Ansari started quarreling pursuant to an incident in which the oxen owned by them were fighting. In the said quarrel, the accused gave 3-4 slaps to the deceased and after sometime the deceased died due to heart attack. The postmortem report would mention the cause of death to be natural due to shock (cardio respiratory failure).

Considering the nature and quality of evidence on record, we are not inclined to grant leave to appeal against acquittal. 4.

Accordingly, the CRMP is dismissed.
