Hon'ble Shri Justice Goutam Bhaduri Order On Board 04.02.2021 Heard.

1. Learned counsel for the petitioner had constructed his house over Khasra No. 1971/1 and out of 1076 sq. feet the house /shop has been constructed. As per the State government policy dated 11.09.2019, he prays for settlement of the land in his favour after payment as per the guidelines which is existing. It is stated that the petitioner was served with a letter dated 27.12.2019, wherein the petitioner has been asked to pay an amount of Rs. 6,52,049/- for grant of lease. It is submitted that the petitioner has made an application to the Tashildar vide Annexure P-3 for exemption of the amount and the same has not been decided.

2. Learned State counsel would submit that the amount has been asked for per the policy of the State, therefore no exemption can be allowed.

3. Considering the limited prayer made, it is directed that the Tahsildar (Respondent No. 3), if is vested with the power to grant the exemption from payment shall may decide the application dated 04.01.2020 (Annexure P-3) within 6 months from the date of receipt of a copy of this order. The petitioner shall apprise the Tahsildar about the order of this Court. It is further observed that this Court has not expressed any opinion in favour of the petitioner.
