Hon'ble Shri Justice Sanjay K. Agrawal Order On Board /0 1 /201 (1) Learned counsel for the petitioner would submit that the petitioner is entitled for second upgraded pay scale since 2001, for which he has already made representation to the respondent No. 2 but the same has not been decided till now and, therefore, a direction may be issued to respondent No. 2 to consider and decide the same expeditiously. (2) Per contra, counsel for the State would submit that the petitioner is not entitled for such second upgrapded pay scale since 2001.
(3) I have heard learned counsel appearing for the parties. (4) Be that as it may, the respondent No. 2 is directed to take decision on the petitioner's representation expeditiously preferably within a period of four weeks from the date of production of certified copy of this order. The petitioner is at liberty to file additional representation, if any.
(5) With the aforesaid observations, the writ petition stands finally disposed of.
(6) It is made clear that this court has not expressed any opinion upon the merits of the case and the authorities concerned would be at liberty to decide the representation in accordance with law on its own merit.
