promotional avenue in the service rules governing the service condition of the petitioner.

According to the counsel for the petitioner, the persons who are similarly placed in the Class-IV cadre like Lab-Assistant etc. are being considered for promotion to the Class-III categorey on completion of minimum length of service, but so far as the petitioner is concerned, for want of any promotional avenues, the petitioner would retire from the same post on which they were appointed and thus prayed for the rules to be amended

Given the aforesaid facts and circumstances of the case, particularly taking into consideration the fact that the relief sought for by the petitioner can only be granted by the State Government as it is the State Government which has make the law and which has a power to modify and amend the same, let the petitioner make a suitable representation in this regard to the respondent No.1 within a period of 3 weeks from today and the respondent No.1 in turn may take a decision on the representation of the petitioner within a further period of 4 months from the date of receipt of representation. 4.
