The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.764/2019 registered in Police Station Kasdol, Distt.- Balodabazar-Bhatapara C.G. for the offence punishable under Section 376 of the I.P.C. ; Section 4 of the Protection of Children from Sexual Offences Act, 2012 & Section 3(2)(v) of the Scheduled Castes and

MCRC No. 578 of 2020 Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. Learned counsel for the applicant seeks permission of the Court to withdraw the bail application with liberty to prefer the appeal under Section 14 A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

4. Permission granted.

5. Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.

6. Certified copy of the bail rejection order be returned to learned counsel for the applicant on supplying xerox copy thereof.
