1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 66/2017 registered at Police Station- Gol Bazar, District - Raipur, (Chhattisgarh) for the offence punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

2. Learned counsel for the applicant submits that the applicant has falsely been implicated as no case is made out against the applicant on the basis of the material available in the charge-sheet. Other co-accused persons, in similar case registered regarding the incident in connection with the application for vacancy in Jila Panchayat, Raipur, have been

Page No.2 granted bail by this Court and by the coordinate bench of this Court. Applicant is in jail since 22.11.2017. As the trial is likely to take some time, hence, it is prayed that applicant be enlarged on regular bail.

3. Learned State counsel opposes the bail application.

4. Heard both the parties and perused the case diary.

5. Against the vacancy advertised by Zila Panchayat, Raipur for the post of Librarian and teacher, the applicant has submitted his application attached the documents. On verification the certificate of B. Lib. and ISic. Purported to be issued by Guru Ghashidas University was found fake and forged.

6. Considered the contents of the case diary and considering the fact that similarly situated co-accused persons have already been granted bail by this Court and the coordinate bench of this Court, I am of this opinion that applicant should be benefited with grant of regular bail.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed.
