The applicant is apprehending his arrest in connection with Crime No.137/2019 registered at police station-Singhoda, District- Mahasamund, (C.G.) for alleged commission of offence under Section 409 of Indian Penal Code.

Prosecution case is that when raid was laid on 2nd of December, 2019 by an inspection team headed by Deputy Registrar Cooperative Society, they found shortage of 157 bags of paddy amounting to Rs.1,13,982/-. 3.
Learned counsel for the applicant submits that the raid was laid in the state of haste without proper counting. A wrong report was prepared. The applicant objected also. Next morning the concerned society again counted bags and everything was found in order.

On the other hand, learned counsel for the State opposes prayer and submits that the inspection team comprised of higher Government officers including Deputy Registrar, Food Inspection, surveyer and the Panchnama of shortage was signed by District Marketing Officer and Secretary of Krishi Upaj
Mandi.

Having considered the submissions of learned counsel for parties and particularly taking into consideration the material placed before this Court, present is not a fit case for grant of anticipatory bail. 6.
Therefore, the application is rejected.
