The appeal under Section 374(2) of the Code of Criminal Procedure, 1973 is preferred against judgment dated 16.3.2017 passed by Third Additional Sessions Judge to the Court of First Additional Sessions Judge, Raigarh (CG) in Session Trial No.123/2016 wherein the said Court convicted the appellant for commission of offence under Section 307 of Indian Penal Code and sentenced to undergo rigorous imprisonment for seven years and to pay fine of Rs.5000/- with default stipulation. 2.
Perused PUD dated 17.9.2019 received from District and Sessions Judge, Raigarh.

In the said PUD it is mentioned that appellant Babulal Uraon has died on 19.5.2019. Death certificate of the appellant
issued by Department of Planning, Economics and Statistics, Govt. of Chhattisgarh is also enclosed along with the PUD. 4.
Learned counsel for the State submits that order may be passed on the basis of the above report.

As no near relative of the appellant has filed application to continue the appeal on behalf of the appellant, the appeal stand abated on account of death of the appellant and proceedings of this Court is culminated due to death of the sole appellant in terms of Section 394 of CrPC.
