HIGH COURT OF CHHATTISGARH, BILASPUR Writ Petition (S) No. 4493 of 2011 Dharmendra Kashyap S/o Sudharam Kashyap, aged about 43 years, R/o Jarhagaon, Tah Mungeli, Distt. Bilaspur, CG ---- Petitioner

Versus

1. State Of Chhattisgarh through the Secretary, Department of School Education, DKS Bhawan, Raipur (CG)

2. Secretary, Tribal Welfare Department, Distt. Bilaspur (CG)

3. Collector, Bilaspur, Distt. Bilaspur (CG)

4. block Education Officer Mungeli, Distt. Bilaspur, (CG) ---- Respondents For Petitioner:

Shri Utkal Pradhan, Advocate.

For Respondents/State:

Shri UNS. Deo, Government Advocate.

Single Bench:

Hon'ble Shri P. Sam Koshy, J Order On Board 18.09.2015 Present is a petition where the challenge is to the order dated 15.7.2011. Records shows that the Petitioner had an interim order in his favour on 10.8.2011 and by virtue of the said order, he had continued at the said place of posting. 2.

In view of the fact that the Petitioner had enjoyed the benefit of the interim protection for over four years, by efflux of time, the grievance of the Petitioner stands redressed and the petition has become infructuous. 3.

Accordingly, the Petition is dismissed as having become infructuous. 4.

Needless to mention that since the order had been passed almost four years back, the State counsel shall not insist upon the compliance of the impugned order and the State however may have the liberty to pass a fresh order in case the need so warrants.
