Versus

1. State Of Chhattisgarh through the Secretary, School Education Department, DKS Bhawan, Raipur (CG)

2. Collector Raigarh, Distt. Raigarh, (CG)

3. Block Education Officer Lailunga, Distt. Raigarh, (CG) ---- Respondents For Petitioner:

Shri BP. Singh, Advocate.

For Respondents/State:

Shri UNS Deo, Government Advocate.

Single Bench:

Hon'ble Shri P. Sam Koshy, J Order On Board 18.09.2015 Through the instant Writ Petition, the Petitioner has challenged the order of relieving her from the Middle School, Balak Lailunga to Middle School, Hardijhariya on 26.7.2011 (Annexure P-1). The Petitioner in the instant case had an interim order in her favour dated 19.8.2011 and since then she has been discharging her duties at the Middle School, Lailunga.

2.

In view of the fact that the Petitioner had enjoyed the benefit of the interim protection for over four years, by efflux of time, the grievance of the Petitioner stands redressed and the petition has become infructuous. 3.

Accordingly, the Petition is dismissed as having become infructuous. 4.

Needless to mention that since the order had been passed almost four years back, the State counsel shall not insist upon the compliance of the impugned order and the State however may have the liberty to pass a fresh order in case the need so warrants.
