1. The present petition has been filed seeking for a direction to the respondents/State to convene meeting of Departmental Promotion Committee (for short DPC) to consider the case of the petitioner for promotion on the next higher post. The petitioner also assails the order of respondent No.4 being appointed as immunization officer.

2. Pending the petition, the respondents have recalled the order of respondent No.4 being appointed as immunization officer and the said charge has been assigned to the petitioner and as such it redresses the grievance of the petitioner so far as relief No.3 and 4 are

concerned.

3. Now, according to counsel for the petitioner, the petitioner, indisputably, is senior to the respondent No.4 and the only grievance which remains is that till now he has not been considered for promotion. Therefore, the concerned authorities be directed to hold a DPC to fill up the sanctioned vacant post and he be granted promotion looking to his seniority.

4. So fas as the prayer for convening DPS and non granting of promotion is concerned, this court is not inclined to issue any direction in this regard to the respondents at this juncture. The issue is left open. The petitioner is at liberty to make detailed representation in this regard to the respondents No.1&2, who in turn shall look into the grievance so far as non holding of DPC is concerned and shall either hold the DPC or suitably inform the petitioner the reasons for not convening the DPC.
