Versus

1. State Of Chhattisgarh Through Principal Secretary, Home Department, Mahanadi Bhavan, Mantralaya, Atal Nagar, Naya Raipur, District Raipur, Chhattisgarh.

2. Director General Of Police, Police Headquarter, Atal Nagar, Naya Raipur, District Raipur, Chhattisgarh.

3. Senior Superintendent Of Police Durg, District Durg, Chhattisgarh. ----Respondents For petitioner- Shri T.K. Jha, Advocate.

For State-Ms. Beenu Sharma, PL.

Hon'ble Shri Justice Goutam Bhaduri Order 28/01/2020 Heard.

1.

Only grievance of the petitioner is that he was appointed as Assistant Sub Inspector in police department and was sent on deputation to transport department. Subsequently, he was repatriated in the year 2004 to the parent department and after joining in the parent department, he met with an accident which resulted into fracture of the vertebra. Consequently, he was on leave for a period in between from 3/09/2004 to 12/05/2005, thereafter he again met with an accident and his leg was fractured, again he was on leave from 18/05/2005 to 22/10/2005. The petitioner contends that for the said leave period, the petitioner has filed an application, however same is not being decided despite the fact it was forwarded by Superintendent of Police several times and letter was sent

on 24/10/2019 by Annexure P-8, therefore respondent No.2, Director General of Police, Police Headquarter, Raipur may be directed to decide the leave application of the petitioner as has been forwarded by the Superintendent of Police, Durg.

2.

Perusal of the record shows that by Annexure P-8 & P-9 on 24/10/2019 and 17/12/2019 a letter has been addressed to the Director General of Police, Police Headquarter, Raipur by the Superintendent of Police, Durg to consider the case of the petitioner for leave so that revised pay scale for the year 2004-2005 can be considered. Taking into such fact, letter Annexure P-9 dated 17/12/2019 which is addressed by the Senior Superintendent of Police, Durg, it is directed that respondent No.2 Director General of Police, Police Headquarter, Raipur shall decide the same within a period of 60 days from the date of receipt of this order. 3.

With such observation, the petition stands disposed of. Sd/- (Goutam Bhaduri) JUDGE gouri
