Taking into consideration the submission of learned counsel for the State that though the prosecution led reliable evidence that immediately after cross firing between the police team and the naxalites, the appellant was caught at the spot itself and firearm as well as explosive both were recovered from his possession, leave to appeal is granted.

Let the appeal filed by the State be registered as acquittal appeal and be listed thereafter.

CRMP is accordingly allowed.
