Hon'ble Shri Justice P. Sam Koshy Order on Board 23/02/2021 1.

The dispute in the present writ petition is in respect of the nonreleasing of the arrears of the 7th pay commission benefits that the petitioner is entitled for.

According to the petitioner, the same has not been released only account of the non-withdrawal certificate not being issued to the petitioner by the Principal of the school, where the petitioner was earlier posted.

Given the said nature of dispute this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending,

rather ends of justice would meet if the District Education Officer, District Gariyaband is directed to look into the grievance of the petitioner and to ensure that all necessary steps are taken for releasing of the arrears of 7th pay commission in accordance with law at the earliest preferably within a period of 90 days from the date of receipt of the copy of this order.

The District Education Officer should also ensure that the nonwithdrawal certificate is issued by the respondent No.4 promptly, so as to ensure that the payment can be released to the petitioner at the earliest within the aforementioned stipulated period of time. 5.

With the aforesaid observations, the present writ petition stands disposed of.
