Agrawal Order On Board 28/01/2019 (1) By the impugned order dated 2.11.2018, plaintiff's opportunity to lead evidence has been closed on the ground that she did not avail opportunity granted to her, against which, instant writ petition has been preferred.
(2) I have heard learned counsel appearing for the petitioner. (3) Taking into consideration the fact that earlier adjournments were based on valid and sufficient grounds, plaintiff is granted further opportunity to examine herself and two other witnesses on the next date of hearing i.e. 12.02.2019 subject to payment of cost of Rs.2,500/- to the defendant. On that day, the defendants are also at liberty to cross examine plaintiff and two other witnesses.
(4) Accordingly, the writ petition is disposed off with above-stated observation reserving liberty in favour of respondent to file application for modification, if any. (5) Copy of the order be sent to the trial Court through concerned District Judge for compliance and needful.
