Grievance of Petitioner in the present Writ Petition is the action on the part of Respondents in holding the Petitioner not meritorious for promotion to the post of Multipurpose Health Worker (Female)/ANM and Rural Health Convener (Female).

Learned Counsel for Petitioner submits that the Petitioner has participated in the aforesaid selection process and secured 52.83 marks whereas Respondent No.4 has secured 51.4 marks and thus the Petitioner is more meritorious ahead of Respondent No.4. Learned Counsel for Petitioner further submits that the Petitioner is also entitled for the marks for the experience that she has, but she has not been awarded any marks for the same otherwise the total marks of Petitioner would have further improved. Learned Counsel for Petitioner also submits that the Petitioner has made a detailed representation/objection in this regard before Respondent No.3 which till date has not been considered and decided.

Learned Additional Advocate General submits that the objection of Petitioner is pending consideration before Respondent No.3 and it would be the competent authority who has to take a decision on the same.

Given the submissions made on either side, the present Writ Petition at this juncture is disposed of directing Respondent No.3 to take an appropriate decision on the representation/objection filed by Petitioner, at the earliest, preferably within a period of 45 days from the date of receipt of copy of this order. 5.

It is made clear that till the Respondent No.3 takes a decision in this regard, one post against the category to which the Petitioner has applied shall be kept vacant.

With the aforesaid direction/observation, the Writ Petition stands disposed of.
