Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 29/01/18 1.

By the impugned order dated 11.12.2017, the petitioner's candidature for appointment on the post of Lecturer (Panchayat) has been rejected against which this writ petition has been preferred by the petitioner. 2.

Learned counsel appearing on behalf of the petitioner would submit that petitioner is entitled for appointment on the post of Lecturer (Panchayat) and, therefore, the order rejecting his candidature is illegal and bad in law.

3.

On the other hand, learned counsel appearing on behalf of the State would submit that the order rejecting petitioner's candidature is appealable under Rule 13 of The Chhattisgarh Teacher (Panchayat) Cadre (Recruitment and Conditions of Service) Rules, 2012 (for brevity "Rules, 2012") 4.

At this stage, learned counsel for the petitioner would submit that he may be allowed to prefer an appeal under Rule 13 of Rules, 2012 before the appellate authority.

5.

I have heard learned counsel for the parties. 6.

Be that as it may, the petitioner would be at liberty to prefer an appeal before the appellate authority in accordance with law within a period of two weeks and if such an appeal is preferred by the petitioner then, the appellate authority shall consider and dispose of the said appeal expeditiously preferably within a period of ten weeks from the date of receipt of copy of this order.

7.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
