1. This is an application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 53/2017 registered at Police Station Pasta, District Balrampur, Chhattisgarh for the offence punishable under Section 376 (2) (i) (m), 506 of Indian Penal Code and Section 5 of Protection of Children from the Sexual Offences Act.

2. Counsel for the applicant prays for withdrawal of the bail application with a liberty to revive the same after the prosecutrix is examined before the trial Court.

3. Accordingly, the present MCRC is dismissed as withdrawn with the aforesaid liberty.
