The applicant has preferred this application under Section 439 of the Cr.P.C for grant of regular bail as he is arrested in connection with Crime No. 170/2017, registered at Police Station- Suhela, District (Revenue & Civil)- Balodabazar- Bhatapara (C.G.) for the offence punishable under Sections 25 & 27 of the Arms Act. 3.

Case of the prosecution is that on 14/11/2017 the applicant along with his friend was searching a prospective customer to sell a pistol. On receiving an information, both have been searched and one pistol was seized from the possession of co-accused.

Learned counsel appearing on behalf of the applicant submits that charge-sheet has been filed, the matter is triable by JMFC, the applicant is in custody since 14/11/2017 and there is no known criminal antecedent of the applicant, therefore, he may be released on bail.

Per contra, learned counsel appearing on behalf of the State opposes the bail application.

I have heard learned counsel for both the parties. 7.

Considering the facts and circumstances of the case, particularly considering that charge-sheet has already been filed, the matter is triable by JMFC, the applicant is in custody since 14/11/2017 and there is no known criminal antecedent of the applicant, without further commenting on merit of the case, this court is inclined to release the applicant on bail.

Accordingly, MCRC. No.765/2018 is allowed. It is directed that the applicant shall be released on bail on executing a personal bond for a sum of Rs. 20,000/- with one surety for the like amount to the satisfaction of the trial Court. Thereafter, he will appear before the Trial Court on each and every date given by the said Court. Sd/- Judge Arvind Singh Chandel Rahul
