(2) Challenge in this petition is to the advertisement dated 17.07.2012 issued by the Directorate of Health Services, inviting applications for appointment on the post of Sister Tutor. The challenge is on the ground that in the matter of Bailadila Berozgar Sangh Vs. National Mineral Development Corporation Ltd. And another (W.P. No.2424/2005, decided on 11.08.2005), a Division Bench of this Court has held that a woman citizen cannot be made ineligible for any employment on the ground of sex only but could be excluded from a

particular employment if there are other compelling grounds for doing so.

(3) On 13.08.2012, this Court stayed the selection process pursuant to the impugned advertisement.

(4) In the return filed by the State, it is averred on the basis of the document - Annexure R/1, that a corrigendum has been issued to make open the selection process for all eligible candidates be it male or female.
