Hon'ble Shri Justice P. Sam Koshy Order on Board 14/12/2018 1.

The challenge in the present Writ Petition is to the order dated 12/08/2017 whereby the petitioner has been transferred from Mulmula, District Janjgir-Champa to Jebel, District Baster (C.G.). 2.

The petitioner has an interim order in his favour on 06/09/2017. The interim order was granted to the petitioner considering the fact that he was disabled by more than 75%.

3.

In the given facts, this Court is of the opinion that, by efflux of time, the impugned order so far as the petitioner is concerned has lost its efficacy.

4.

Accordingly, the instant Writ Petition stands disposed off with a direction that the respondent/State shall not act upon the order of transfer any further so far as petitioner is concerned reserving their right to pass a fresh order in case administrative exigency so arises. Ofcourse, while doing so, the respondents keep in mind the disability of the petitioner. Sd/- (P. Sam Koshy) Sumit JUDGE
