The present petition has been filed against order dated 22.12.2020 passed by Judicial Magistrate First Class, Sarangarh, Distt. Raigarh, whereby the learned Magistrate rejected the application of the petitioner filed under Section 451 CrPC for releasing his vehicle.

The petitioner's vehicle Hero Splendor bearing registration No.CG 06 GC 2267 has been seized by the Forest Department, Baramkela in connection with Crime No.4578/14 for the offence punishable under Sections 43, 39d, 48a and 49 of the Forest Act.

Learned counsel for the State would submit that the order impugned is revisable and the petitioner could have filed revision before the court of session.

In that view of the matter, instant petition stands disposed of. The petitioner is at liberty to file revision before the Session Court within two weeks from today and the same will be considered by the said Court in accordance with law expeditiously.
