Hon'ble Shri Justice P. Sam Koshy Order On Board 04.08.2016 The present petition has been filed challenging the impugned order dated 31.07.2012 whereby the petitioner has been transferred from the Government Engineering Visvesaraya Post Graduate College, Korba to Govt. College Kartala, Korba.

The present petition was filed on 09.08.2012 and the petitioner was granted an interim protection by this Court on 13.08.2012 by virtue of which the petitioner is still working at Government Engineering Visvesaraya Post Graduate College, Korba.

At this juncture, State counsel makes a submission that by efflux of time the State shall now not act upon the impugned order dated 31.07.2012 and the petition to that extent may be disposed of reserving the right of the State Govt. to pass a fresh order in case the exigency so arises.

The said submission made by the State counsel appears to be fair and justified.

Accordingly, the present writ petition stands disposed of to the extent that the State shall not act upon the impugned order dated 31.07.2012 so far as it relates to the present petitioner is concerned. 6.

However, the respondent authorities would have the liberty to pass a fresh order in case the exigency so arises and the disposal of this petition as well as the interim protection granted in this petition would not come in the way of the State for passing a fresh order.
