Learned counsel for the appellant would submit that the appellant has served the entire sentence since his period of detention 14-10-1996 till 25-102004 and he has been released after sewing the entire sentence. With this, as "the appellant has served the entire sentence, as instructed, she is not contesting the instant criminal appeal.

Therefore, let the appeal may be disposed of accordingly.

The appellant held convicted under Section 376(2)(g) and Section 450 of the IPC and sentenced to undErgo rigorous imprisonment for 10 years and to pay fine of Rs.1000/~, in default of payment of fine, to undergo additional simple imprisonment for year, the trial Court also sentenced rigorous imprisonment for 7 years and to pay fine of Rs.1000l-, in default of payment of ' 'fine, to undergo additional simple imprisonment for 1 year, with a direction that both the substantive jail sentences shall run concurrently. 5.

As submitted on behalf of the learned counsel for the appellant that she

is not contesting the instant criminal appeal on its merit and even after perusal of the record of the Court below, i do not see any reason to interfere with the conviction and sentence awarded by the trial Court, and as the appeilant served the entire sentence and released thereafter, he is not contesting the instant criminal appeal, consequently, the appeal filed by the appellant is hereby dismissed.
